Our client, a major national Top 50 law firm has a fantastic opportunity for a senior construction litigation solicitor initially for 5-6 months, with a view to extend potentially for 2-3 years if it goes to a formal dispute. The firm is open to individuals seeking to work 4 or 5 days a week.
Acting for two county councils, the dispute has arisen under a PFI contract relating to a large waste-to-energy project. The contract has been terminated as a result of the contractor's failure to pass the acceptance tests by the longstop date. The parties are now dealing with issues relating, in a broad sense, to compensation on termination. The difference between the parties is a valuation of approximately £200m.
The issues include the design and construction of the facility itself, and its ability to meet the output specifications of the contract, along with similar issues arising at various waste transfer stations, and complex questions of contractual interpretation.
The successful construction litigation solicitor is likely to have upwards of 8+ PQE with solid construction litigation experience from a major law firm, along with experience managing a team of junior lawyers.
Experience in PFI disputes would be a distinct advantage, but is not essential.
